Our Privacy Policy

“Personal information about an identifiable individual that is collected for, hosted by, and used on this website may be governed by the Alberta Personal Information Protection Act (PIPA). Beyond Compliance Inc. has implemented physical, administrative and technical safeguards to ensure such information is not used in a manner other than for the client's intended purpose. If you are collecting personal information for use on this website, it is your responsibility to check with your company’s privacy officer to ensure that the proper consents to collect and use this information have been obtained.”

The following privacy policy discloses Beyond Compliance’s practices and policies regarding the gathering and dissemination of personal information.

Personal Information We Collect

When you become a client of Beyond Compliance, you may subscribe to various automated workflow processes that use personal information. This information includes:

employee names
training history
workplace behaviors and aptitudes
workplace knowledge and skills
competency assessments
performance indicators
workplace incidents specific to employees

This information is collected and used for two purposes:

(1) To establish and maintain a commercial relationship with you and to provide you with Beyond Compliance products and services.

Personal information is required in order to use several different Beyond Compliance automated workflow processes – e.g. Job Performance Management System™ and Workplace Incident Tracking System™. Such information is hosted on our web site to allow you to use these various applications and is only retained in data archives for internal management and auditing purposes.

(2) To meet legal, regulatory, and security requirements (such as in response to a court order), and otherwise as permitted or required by law.

If we intend to use personal information for purposes not identified to you or as set out above, these other purposes will be described to you at the time of collection or before using the information. We will not use your information for any other purpose without your consent.

Cookies

Beyond Compliance uses cookies to identify "sessions". Sessions are a means for our server to recognize that a user has been authenticated. The cookie simply consists of a unique sequence of characters that the server internally matches up with a logged-in user. The cookie itself contains no personal information and is not combined with personal information.

Third Parties' Access to Personal Information

Beyond Compliance does not sell client information to any outside entity. However, Beyond Compliance will release personal information to the appropriate law enforcement, governmental or other authorities if legally required to do so.

Security

Beyond Compliance uses appropriate safeguards to protect personal information against such risks as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction.

Consent

In some of the Beyond Compliance workflow applications, there is a requirement for personal information to be stored within Beyond Compliance’s database. According to PIPA, it is the user’s responsibility to notify individuals from whom information is collected about the fact that the information is being collected, and why it is being collected. Therefore, we require that each client consults with his or her corporate privacy officer, and obtains consent to collect, use and disclose such information for the purposes identified or described in this privacy policy, if applicable, or as otherwise described at the time of collection. The person that provides this information may withdraw his or her consent to such collection, use and disclosure of personal information at any time, subject to contractual and legal restrictions and reasonable notice, however, if such consent is withdrawn, we may no longer be able to host such information.

In certain circumstances, Beyond Compliance and its clients may collect, use or disclose personal information without that person’s knowledge and consent, for example:

when it is clearly in the interest of the user and consent cannot be obtained in a timely way, such as in a medical emergency;
when the life, health or security of another individual is threatened;
if seeking consent might defeat the purpose, such as for the investigation of a breach of an agreement or law; and
when disclosure is to the member's lawyer, to collect a debt, to comply with a court order, or as may otherwise be required by law.

Beyond Compliance will provide full and fair disclosure of its collection use and disclosure pursuant to these principles.

As a private corporation, Beyond Compliance is governed by the requirements of PIPA. Therefore, Beyond Compliance is required, by virtue of section 6 of PIPA, to develop and follow policies and practices that are reasonable for Beyond Compliance to meets its obligations under PIPA, and to make this information available on request to both our employees and our clients. In certain situations, Beyond Compliance may not be able to give users access to all personal information we hold about the user, for example:

if it might reveal personal information about another user or could threaten the life or security of another individual;
if it might reveal confidential commercial information;
if the information is protected by solicitor-client privilege;
if the information was generated in the course of a formal dispute resolution process; or
if the information was collected in relation to the breach of an agreement or a law.

Beyond Compliance will explain the reasons for denying access when asked.

This policy is in effect as of January 1, 2004. Beyond Compliance reserves the right to change this privacy policy at any time by posting the policy changes on our web site. Site users are advised to periodically check this web site for such changes.
